Terms of Service

1. Overview
These Terms of Service (hereinafter referred to as "Terms") constitute a legally binding agreement between you (the "User") and Mountains Studio LLC, a limited liability company organized under the laws of Wyoming, with its registered office at 30 N Gould St Ste R, Sheridan, WY 82801 (hereinafter referred to as the "Publisher," "we," or "us").
These Terms govern your access to and use of the application "Blow Up AI" (hereinafter referred to as the "Application").
By downloading, installing, or using the Application, the User unconditionally accepts these Terms. If the User does not accept these Terms, they are requested not to use the Application.
2. Description of Services & AI Integration
The Application provides tools for social media analysis, content optimization, and automated publishing powered by Artificial Intelligence (AI).
2.1. Core Features
The process works as follows:
- Onboarding: The User logs in and connects their TikTok account.
- Analysis: The Application collects data (including transcripts via external APIs) to generate an initial profile analysis.
- Premium Features: Upon subscription, the User unlocks full capabilities: deep video analysis, content idea generation, external video analysis, script generation, and automated reposting to other platforms.
2.2. Artificial Intelligence
The Application integrates third-party AI technologies (such as Anthropic's Claude or Google's Gemini). By using the Application, you acknowledge and agree that:
- Data Processing: Content you provide (transcripts, metadata) will be sent to these third-party AI providers for processing.
- Accuracy: AI-generated content is for informational and creative purposes only. We do not guarantee the accuracy or reliability of AI suggestions. AI models can occasionally produce incorrect information ("hallucinations").
3. Account and Registration
To access the Application, you must authenticate using your Apple ID or Google Account.
3.1. Social Media Connection
The Application requires access to your third-party social media accounts (TikTok, YouTube, Instagram, Facebook). By connecting these accounts, you represent that you are the owner of said accounts.
3.2. Platform-Specific Terms
You agree to be bound by the Terms of Service of the connected platforms:
- YouTube: By using our Client, you agree to the YouTube Terms of Service (https://www.youtube.com/t/terms). You also acknowledge Google's Privacy Policy.
- TikTok, Meta (Instagram/Facebook): You agree to comply with their respective Terms of Use.
4. User Content and Conduct
4.1. Responsibility
You are solely responsible for the content you create, analyze, or repost via the Application.
4.2. Prohibited Content (AI Safety)
You strictly agree NOT to use the Application or its AI features to analyze, generate, or propagate content that is:
- Illegal, pornographic, sexually explicit, or violent.
- Hate speech, harassment, or bullying.
- Infringing on the intellectual property or privacy of others.
We reserve the right to ban any User found using the AI tools for malicious or prohibited purposes.
4.3. Automated Reposting
By using the repost feature, you represent that:
- You own all necessary rights to the original video.
- You authorize the Application to process, download, and re-upload this content on your behalf.
5. Subscriptions, Payments, and Refunds
5.1. Business Model
The Application operates on a Freemium model. Advanced features require a paid subscription.
5.2. Payment Processors
Depending on how you purchase the subscription, payments are processed by one of the following providers:
- Apple App Store: For in-app purchases on iOS devices. Billing is handled according to Apple's terms.
- Google Play Store: For in-app purchases on Android devices. Billing is handled according to Google's terms.
- Paddle: For web-based purchases. Paddle acts as our Merchant of Record and handles billing according to Paddle's Consumer Terms (Paddle's Consumer Terms).
5.3. Cancellation Policy
Subscriptions may be cancelled at any time through the user's account. Cancellation will take effect at the end of the current billing period.
- Apple App Store / Google Play Store: Cancel via your device settings at least 24 hours before the end of the current billing period.
- Paddle: Cancel via your account settings or by contacting support.
5.4. Refund Policy
- Apple App Store / Google Play Store: Refunds are handled by the respective platform in accordance with their policies. Please contact Apple or Google directly for refund requests.
- Paddle: You are entitled to a full refund within 14 days of your purchase, no questions asked. Simply contact contact@blowup-app.com to request your refund.
In case of billing errors, accidental charges, or verified technical issues, users may contact contact@blowup-app.com for review.
5.5. Digital Content Acknowledgment
By subscribing, you acknowledge that the Application provides immediate access to digital content and services. In accordance with applicable consumer protection laws, you consent to the immediate performance of the service.
For Paddle (Web) purchases: Notwithstanding the above, you retain your full right to a refund within 14 days of purchase, regardless of usage.
6. Intellectual Property
6.1. Our IP
Mountains Studio LLC owns all rights to the Application's code, design, and proprietary software.
6.2. AI Output Ownership
As between you and us, you retain ownership of the specific scripts and ideas generated for you by the AI. We claim no ownership over the content you create.
7. Limitation of Liability
To the fullest extent permitted by applicable law (Wyoming):
- Service: The Application is provided "as is".
- AI & Platforms: We are not liable for any loss of engagement, account suspension (shadowban), or negative feedback resulting from the use of AI scripts or automation. Use the Application at your own risk.
- Damages: Mountains Studio LLC shall not be liable for indirect or consequential damages.
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Wyoming, United States. Any dispute shall be resolved through binding arbitration in Sheridan, Wyoming, except where prohibited by mandatory consumer laws in your country of residence (e.g., EU consumer protection laws).
